Consumer groups have petitioned the California Supreme Court to overturn a lower court ruling that potentially restricts insurance coverage for damages resulting from wildfire debris. The move comes shortly after California’s insurance regulator issued a clarification, stating the ruling’s limitations do not widely apply to smoke damage claims.
“Given the devastating impact of recent wildfires in Los Angeles County, the signatories are deeply concerned about the Gharibian opinion’s potential to harm California policyholders seeking coverage for fire-related losses,” the groups stated in a letter submitted to the Supreme Court on Monday. The letter was co-signed by several organizations, including the Consumer Attorneys of California, the Consumer Attorneys Association of Los Angeles, and Consumer Watchdog.
